MyAltaMed Patient Portal Terms of Use

In order to access and use the Internet-accessible MyAltaMed Patient Portal system (“MyAltaMed”) furnished by AltaMed Health Services Corporation (“AltaMed”), you must agree to and comply with the terms of this agreement. If you do not agree to comply with the terms of this agreement, then you are not authorized to use MyAltaMed, and you must not access or otherwise use MyAltaMed, or permit any other persons to do so.

1. Use Limitations. You agree not to use, or to authorize or permit others to use, MyAltaMed, except as expressly authorized in this agreement. You also agree not to authorize or permit others to, copy, modify, adapt, sell, license, create derivative works from, or otherwise transfer all or any part of MyAltaMed or any User Data (as such term is defined in Section 2 below) relating thereto. You further agree that you will not authorize or permit others to, reverse engineer, reverse assemble, reverse compile, decompile, disassemble, or otherwise translate all or any part of MyAltaMed, nor will you use or authorize or permit others to use any mechanical, electronic or other methods to trace, decompile, disassemble or identify the source code or data model of MyAltaMed or any part thereof.

2. MyAltaMed Inputs. You acknowledge and agree that during the term of this agreement, if you are authorized to input any information into MyAltaMed or provide AltaMed or its designee with information to be inputted into, or otherwise used in conjunction with MyAltaMed, then you agree to assume sole and complete responsibility for the accuracy, completeness, reliability, quality and timeliness of all information that is inputted by you into MyAltaMed, or is provided by you to AltaMed or its designee to be included in MyAltaMed, including user names, login, password, and security information, and for promptly reporting to AltaMed any and all errors, omissions and updates to the foregoing (the foregoing information is collectively referred to as the "User Data").

3. Proper Subject Matter. You agree to use MyAltaMed for non-urgent medical related questions, lab results, selected results, appointment reminders, and medication lists. Emergency situations requiring immediate attention should not be submitted electronically.

4. Site Links. MyAltaMed may contain links related to websites not managed by AltaMed. These web site links are for informational purposes only. You agree not rely on any of the information in or on these websites for medical diagnosis or treatment. You also agree to seek the advice of your physician with any questions you may have regarding a medical condition and not disregard medical advice or delay seeking it because of something you may have read linked to MyAltaMed.

5. Sensitive Information. You agree not to use MyAltaMed to communicate sensitive subject matters relating to litigation related matters.

6. Medical Records. You acknowledge that you will not have immediate access to your entire medical record through MyAltaMed and will only have access to some parts of the record. Not all test results will be made available through MyAltaMed and may request a copy of your records through AltaMed’s Health Information Management Department.

7. Privacy of Communications. You acknowledge and agree that communications concerning your personal health information carry a level of risk. You acknowledge that a variety of healthcare and administrative personnel will be involved in reading, processing, and replying to information submitted through MyAltaMed. You consent to receiving e-mail communications to the e-mail address provided for MyAltaMed for both notifications concerning AltaMed services and for other medical and business purposes. You acknowledge that AltaMed cannot guarantee the confidentiality, security, or integrity of e-mail communications.

8. Security of Access. You are solely responsible for the security of your user name and password to MyAltaMed. You agree at all times: (i) to hold in trust and confidence your user name, passwords, logins, keys, and any other device or information provided to you to enable your access to and use of MyAltaMed; (ii) without the prior written notice to AltaMed, not to authorize or permit any other person to access, know, or use your user name, password, or any other device or information that enables you to access to AltaMed; (iii) not to access MyAltaMed on behalf of any others who are not authorized to access MyAltaMed; and (iv) to immediately report to AltaMed any theft, loss, misuse, compromise, or other incident relating to the security of MyAltaMed.

9. Means and Scope of Access. At all times, AltaMed reserves the right in its sole discretion to determine, change, suspend, remove and restrict the means and scope of access to MyAltaMed, including but not limited to, requiring the use of or changing user names and passwords, limiting the duration of access, and restricting the scope of access to specific or limited portions of the System, in each case without notice or liability to you or any others.

10. Term and Termination. You acknowledge and agree that MyAltaMed account access may be terminated and disabled for failure to abide by the Terms of Use. This agreement shall become effective on the date that you indicate your agreement, and shall continue thereafter until terminated as provided herein. Either party may terminate this agreement at any time, without cause or penalty, and with or without notice to the other party. In addition, AltaMed may terminate this agreement if you engage in any activity or practice that constitutes a violation of this agreement.

11. DISCLAIMER OF WARRANTIES. ALTAMED EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, ARISING IN CONNECTION WITH THIS AGREEMENT, OR ITS IMPLEMENTATION, OR ARISING OUT OF A COURSE OF PERFORMANCE, DEALING, OR TRADE USAGE, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF TITLE, NONINFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR UNINTERRUPTED OR ERROR-FREE USE OR OPERATION OF MYALTAMED. YOU ACKNOWLEDGE THAT MYALTAMED IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

12. LIMITED REMEDIES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTAMED SHALL IN NO EVENT BE HELD LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT OR PUNITIVE DAMAGES THAT MAY BE INCURRED OR SUFFERED BY YOU OR ANY OTHER PERSON, WHETHER UNDER THE LAWS OF CONTRACT, STRICT LIABILITY, TORT OR OTHERWISE, AS A RESULT OF THE USE OR INABILITY TO USE MYALTAMED. THE LIMITATIONS CONTAINED IN THIS SECTION APPLY TO ALL CAUSES OF ACTION IN THE AGGREGATE, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY (INCLUDING STRICT LIABILITY).



By signing below, I acknowledge that I have read, received and agreed to comply with the MyAltaMed Terms and Conditions. I understand the risks associated with using the MyAltaMed, including compromise of protected health information resulting from an encrypted e-mail being delivered to the wrong address because I did not update the MyAltaMed with my new e-mail address. I understand that emergent and urgent issues should be handled by going to an urgent care clinic or emergency room or calling 911 should the emergency be life threatening. I understand that in order to have a MyAltaMed account, I must be either (i) at least 18 years old; or (ii) be an emancipated minor and have, to AltaMed’s reasonable satisfaction, provided evidence of my emancipated status to AltaMed. I have had a chance to ask questions and have received answers to my satisfaction.

I consent to receive my lab test results by internet posting or other electronic means. However, the following test results and information will only be shared through MyChart after a healthcare professional has the opportunity to discuss the lab results with me.

  • (1) Positive HIV Test.

  • (2) Presence of antigens indicating a hepatitis infection.

  • (3) Abusing the use of drugs.

  • (4) Test results related to routinely processed tissues and imaging scans that reveal a new or recurrent malignancy.
